KBB Momentum Ltd is the controller for personal information it uses to operate this website, respond to enquiries and provide its consultancy, mentoring, programmes and client support. This policy explains our approach under applicable data-protection law, including the UK GDPR and Data Protection Act 2018, as amended.
2. Information we use and where it comes from
We receive information directly from you when you email, book a call, complete a Business Health Check, enter a programme or use a client account. It may include your name, business contact details, role, business details, assessment answers, goals, workbook responses, action plans, messages, meeting arrangements and transaction records.
We may also receive relevant information from someone in your business who arranges an engagement, a referral you authorise, or public business sources when dealing with a business enquiry. We will explain any materially different use where required.
Our website and hosting systems may process IP addresses, browser and device details, login events and security logs. Please avoid sending unnecessary customer or employee details, passwords, payment-card details or sensitive personal information in workbooks or enquiries.
3. Why we use information and our lawful bases
- Enquiries and bookings: to respond, arrange a call and discuss requested work. We rely on steps towards a contract where applicable, or our legitimate interests in handling business enquiries.
- Delivering support: to provide agreed consultancy, programmes, workbooks, client access and follow-up. We rely on contract where you are the contracting individual, or legitimate interests in delivering a business client’s engagement.
- Administration and security: to keep records, protect accounts, resolve problems and prevent misuse. We rely on legitimate interests, taking account of your rights.
- Legal and accounting requirements: to meet applicable obligations, and establish or defend legal claims. We rely on legal obligation or legitimate interests, as appropriate.
- Optional marketing and tracking: on consent where required, or another lawful basis only where the applicable rules permit it.
Information needed to arrange or deliver requested work may be necessary for that service. If you do not provide it, we may be unable to proceed. Optional marketing is not a condition of receiving support.
4. Bookings, assessments and service providers
Calendly is used for call bookings and ScoreApp for the Business Health Check. Information you submit through those services is used to handle your booking or assessment and provide the response you requested. Those providers may also process information for their own purposes, explained in their privacy notices.
We use website hosting, email, account and technical-support services to run the business. We may share relevant information with these providers, professional advisers and authorities where necessary and lawful. Access is limited to what is needed for the purpose.
We do not sell your personal information. We do not automatically add you to an Every Install or EveryTrade Pro membership or share your assessment answers with a retailer, manufacturer or sponsor. Any arrangement involving sharing identifiable participant information will be explained separately.
5. Client records and confidentiality
Client workbooks, programme responses, agreed actions and support notes are used to deliver and administer your support. They are not public profiles. Access is limited to authorised people who need it for service delivery, administration or technical support.
We will explain and agree any recording of a session before recording starts. We will ask permission before using an identifiable testimonial or case study.
6. Marketing choices
We may send the booking, assessment, service and account messages you request or need. A request for a Health Check does not by itself mean consent to unrelated marketing.
We send optional marketing only where permitted by the applicable rules. You can withdraw consent or object to direct marketing at any time using an unsubscribe option or by emailing Mark. We may keep a minimal suppression record so that we respect your choice.
7. Cookies
Cookies used for login, security and website functions are described in our Cookie policy. The website pages do not load advertising pixels or optional analytics tags. Booking and assessment services are opened through external links and have their own cookie information.
If optional tracking is introduced, we will update the information and provide the appropriate choices before it is used where consent is required.
8. International handling
KBB Momentum Ltd is registered in the UK. Mark works from Vancouver, Canada, so information may be accessed there when he responds to you or delivers support. Technology providers may also process data in other countries.
Where a restricted international transfer requires safeguards, the applicable arrangements must use a valid mechanism, such as UK adequacy regulations where they cover the recipient, or approved contractual protections. You can contact us for details of the arrangements applying to your information. We do not assume that every transfer to Canada is automatically covered by adequacy.
9. How long information is kept
We keep information only for as long as it is needed for its purpose. Enquiry records are kept while relevant to the enquiry and any resulting relationship, then reviewed for deletion. Programme and client records are kept for the agreed access period and any further period needed to support the engagement, resolve issues or protect legal rights.
Invoices, accounting and contractual records may need to be kept for six years or longer where a legal obligation or unresolved claim requires it. Marketing contact information is reviewed when you unsubscribe; a minimal suppression record may remain. Security records and backups follow the relevant system’s retention arrangements. Ask us if you need the retention details for a particular record.
10. Security
We use appropriate technical and organisational measures, including controlled access and secure account systems, to protect information. No online transmission or storage system can be guaranteed completely secure. Contact us promptly if you suspect an account or information-security problem.
11. Your rights and complaints
Depending on the circumstances, you may ask to access, correct, delete, restrict or transfer your information, object to processing, and withdraw consent where we rely on it. You have an absolute right to object to direct marketing. Some rights are subject to legal exceptions.
Email Mark to make a request. We may need proportionate evidence of identity. We normally respond within one month, subject to any extension allowed by law, and will explain if we cannot fulfil a request.
You can complain to us and to the UK Information Commissioner’s Office at ico.org.uk, or your relevant local supervisory authority.
12. Children, automated decisions and changes
Our consultancy and programmes are aimed at adults running or working in businesses. We do not knowingly seek personal information from children through this website.
Health Check results may be generated from your answers to help identify possible areas for attention. They do not make legally binding or similarly significant decisions about you.
We will update this policy when our services or data handling change and provide further notice where required.
