KBB MOMENTUM / v1.0
Programme terms and conditions
Programme terms and conditions
Version 1.0 — 19 October 2026. Your completed booking confirmation will set out the programme,
agreed dates, applicable tax and full total before you accept or pay.
1 Parties and the agreement
These terms apply to the guided business development programmes supplied by KBB Momentum Ltd,
company number 16826204, registered in England and Wales, registered office SIU Offices, 4-6
Greatorex Street, London, E1 5NF, United Kingdom. Contact: mark@kbbmomentum.com. “We”, “us”
and “our” mean KBB Momentum Ltd. “You” means the person or business buying the programme,
identified in the booking confirmation.
The agreement consists of your booking confirmation and the version of these terms supplied before
acceptance. The confirmation must identify the participant, programme, included sessions, full price
and tax, payment due date, start date, access end date and final session booking date. We will give you
copies to retain. Any specific variation must be clearly identified and agreed in writing before it applies.
The programme is intended for business owners buying support for their business. The actual purpose
of a purchase determines whether consumer rights apply. No business-purpose declaration or other
term removes rights that apply by law.
2 Acceptance and payment
Before enrolment, you must expressly accept the booking confirmation and these terms. If accepting
for a business, you confirm that you have authority to do so. Payment in full is required by the date on
the invoice and before programme access is provided. We do not offer instalments, deferred payment
or credit. The invoice sets out the available payment methods and any secure payment link.
All prices are in GBP unless the confirmation expressly states otherwise. The confirmation and invoice
will state any applicable tax and the full amount payable before acceptance. There is no recurring
subscription or automatic renewal. We will not charge for additional work without your prior agreement.
After acceptance and receipt of cleared payment, we will confirm the agreed start and provide access
instructions. Payment alone does not substitute for express acceptance of the terms. If payment has
not arrived, we will contact you before changing the planned start. We will not retain payment for a
programme we cannot provide.
3 Scope and delivery
The programme includes the modules, workbook, portal access, action tracking, baseline and final
review, and one-to-one sessions specified in the confirmation. RESET ordinarily includes seven one-hour
sessions, BUILD ten and CHOOSE seven. Each programme can be purchased independently. A
complete-journey purchase includes all three and 24 one-hour sessions, taken in the sequence and
dates agreed.
Indicative durations are 12-14 weeks for RESET, 16-20 weeks for BUILD and 12-14 weeks for CHOOSE.
These estimates do not replace the actual agreed dates. Breaks, extensions and changes to the
sequence require written agreement. No further programme or paid service is added automatically.
We will provide the agreed service with reasonable care and skill. The service is mentoring and
business development support; it is not done-for-you implementation, technical installation supervision,
legal advice, regulated financial or investment advice, or tax advice. Obtain appropriate specialist
advice when a decision requires it. Unlimited messaging and urgent on-demand support are not
included.
4 Your participation and business decisions
You agree to give information that is accurate to the best of your knowledge, complete the relevant
exercises, prepare for sessions and make reasonable time to consider and implement the actions you
choose. Tell us promptly if information changes, guidance is unclear or circumstances affect your
participation. You remain responsible for running your business and deciding whether an action is
appropriate for it.
We provide the agreed structure, guidance, challenge and support. You provide the business
information, make the decisions and carry out implementation. Lack of participation does not mean
that the agreed service was not supplied, but it does not prevent you raising a concern about its quality
or exercising cancellation or other applicable rights.
5 Outcomes and expectations
Outcomes depend on your starting position, participation, implementation, business decisions, market
conditions and other factors outside our control. We do not guarantee any particular revenue, profit,
growth, workload reduction, valuation or commercial result. Case studies, examples and testimonials
are not promises that another participant will achieve the same outcome.
This clause does not excuse a failure to provide the agreed service with reasonable care and skill, allow
inaccurate descriptions of the programme, or remove any remedy or liability that cannot lawfully be
excluded.
6 Sessions and changes to appointments
Book sessions using the programme booking instructions. Programme appointments are separate from
the complimentary introductory call. Attend on time and give at least 24 hours’ notice where possible if
you need to move a session. We will seek a reasonable alternative within your agreed booking period.
A missed appointment or notice of less than 24 hours may mean the reserved session is treated as
used, but only where reasonable in the circumstances, taking account of emergencies, any
replacement booking and the actual loss of the reserved time. It is not an automatic financial penalty. If
you are late, the session may still finish at the booked end time.
If we cancel a session, it will not count against your allowance. We will offer an alternative and extend
the booking period where reasonably needed. If we cannot provide it, you can request a proportionate
refund for the undelivered part.
7 Access dates and materials
Portal access and the session booking window run for the dates in the confirmation. We will make the
end dates clear. Contact us before they expire if you need a pause or extension; changes require
written agreement and will not be charged without prior agreement. There is no promise of lifetime
portal access. A pause or extension must also state what happens to the session allowance and access
dates.
Access is personal to the enrolled participant. Keep your password secure and do not share your
account. We may temporarily restrict access where reasonably necessary to address suspected misuse
or a security incident, explaining the reason where lawful and restoring access when the issue is
resolved. Material or repeated misuse may be dealt with under section 10.
We retain intellectual property rights in our programme materials. You receive a non-exclusive licence
to use them within your own business. You may retain a lawfully downloaded workbook for that purpose
after portal access ends. You must not resell the materials, publish them, share your login or use them
to deliver a competing training programme. You retain rights in your own business information and
answers. Any technical outage will be addressed within a reasonable time, with an appropriate
extension or remedy where it materially affects delivery.
8 Cancellation and refunds
Tell us clearly if you want to cancel, preferably by email to mark@kbbmomentum.com so there is a
record. Before the agreed start and before any programme service or digital materials have been
supplied, we will refund the programme payment in full. After supply begins, we will account fairly for
what has actually been delivered and refund the unused balance, subject to any overriding statutory
right.
For cancellation accounting, the agreed programme fee is allocated proportionately across the included
sessions, including their associated programme support. For a complete journey, 30% of the price is
allocated to RESET, 40% to BUILD and 30% to CHOOSE, then divided across the sessions in each stage.
We will deduct only for supplied sessions and their associated support, including a missed session
reasonably treated as used under section 6. Digital materials are included without a separate
cancellation charge. We will not retrospectively reprice completed stages at a higher standalone fee
merely because a journey is cancelled. Any calculation remains subject to statutory rules and must not
exceed a lawful, fair amount for what was supplied.
We will explain the calculation and make any refund due without undue delay, normally within 14 days,
using the original payment method where possible. Statutory cancellation and refund rules take priority
where they apply. Dissatisfaction with a business result alone does not establish poor service; concerns
about delivery will be assessed on their merits.
9 Additional rights for consumers
Where you are legally a consumer buying at a distance, you normally have 14 days after the day the
contract is made to cancel without giving a reason. A clear statement is sufficient; you may use the
cancellation form below. This is additional to remedies for a service or digital content that is not
supplied as required by law.
We will not start services within that cancellation period without your express request. If you request an
early start and then cancel within the period, only a lawful proportionate charge for the services
supplied may be made, provided the required information and request were obtained. Acceptance of
these general terms alone is not an early-start request.
For immediate supply of digital content, any express consent and acknowledgement of loss of the
relevant cancellation right must be obtained separately, and confirmed in a durable record, before
supply. Loss of a digital-content cancellation right does not automatically remove rights relating to the
unperformed mentoring service. Without the necessary consents we will wait until the applicable period
ends. Where required information was not supplied, any extended cancellation right and other
statutory protections remain available.
Model cancellation form: To KBB Momentum Ltd, SIU Offices, 4-6 Greatorex Street, London, E1 5NF,
United Kingdom; mark@kbbmomentum.com. I/We give notice that I/we cancel my/our contract for
[programme/service]. Ordered on [date]. Name [name]. Address [address]. Signature [only if sent on
paper]. Date [date].
10 Ending or changing the agreement
Neither party may make a material change to the price, support allowance or other agreed scope
without the other’s agreement. If delivery becomes impossible or a material change cannot be agreed,
either party may end the undelivered part and an appropriate refund will be made.
For a material breach, the other party may give written notice describing the problem and a reasonable
opportunity to remedy it, normally at least 14 days where a remedy is possible. Serious abuse, unlawful
conduct, fraud or a security threat may justify immediate action. Any restriction or ending must be
proportionate and will not automatically forfeit all prepaid fees. Statutory remedies remain unaffected.
11 Confidentiality and personal information
Both parties will keep non-public business information received through the programme confidential.
This does not prevent lawful disclosure where required by law, where information is already lawfully
public, or to authorised professional advisers and service providers under appropriate confidentiality
obligations. Do not submit information about another person unless you are entitled to do so.
We handle personal information under the privacy notice supplied with your booking confirmation. It
explains purposes, service providers, retention and rights. We will not publish your identity, business
information, answers or results in a testimonial or case study without separate permission. Sessions will
not be recorded without separate agreement.
12 Responsibility and complaints
Each party is responsible for its own breach of this agreement and for losses for which it is legally
responsible. These terms do not impose a blanket exclusion of our responsibility for the service.
Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury
caused by negligence, or any liability or rights that cannot lawfully be excluded or limited.
Email mark@kbbmomentum.com with any concern and enough information for us to investigate. We
will acknowledge it within five working days and aim to provide a substantive response within 20
working days, explaining any reasonable delay. This process does not prevent either party using other
available legal remedies.
13 Governing law and acceptance
The agreement is governed by the law of England and Wales and disputes may be brought in its courts,
subject to any mandatory law, jurisdiction or consumer right that applies to you. A consumer keeps any
right to bring proceedings in the courts of their home jurisdiction. If a provision cannot lawfully be
enforced, the remaining provisions continue so far as they can operate fairly.
To accept, use an unticked acceptance control or give an explicit written confirmation: “I have read and
accept booking confirmation [reference/version] and KBB Momentum programme terms [version/date],
including the fee payable in full, programme scope, participation requirements and cancellation
arrangements.” We will retain the acceptance record and provide you with copies.
